1. Acceptance of Terms

By downloading, installing, or using the MyRunCoach mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and E.W. Technologies, LLC (“we,” “us,” or “our”). We may update these Terms from time to time, and your continued use of the App constitutes acceptance of any changes.

2. Description of Service

MyRunCoach is a fitness application that provides:

• Personalized running training plans
• Progress monitoring and analytics
• Workout scheduling and reminders

The App is designed to assist with fitness goals but is not a substitute for professional medical advice, diagnosis, or treatment.

3. Eligibility and Account Requirements

3.1 Age Requirements

You must be at least 13 years old to use this App. Users between 13-17 years old must have parental consent to use the App and create an account.

3.2 Account Creation

While basic functionality is available without an account, certain features require account creation. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

3.3 Account Deletion

You may delete your account at any time through the App settings. Account deletion will permanently remove your data within 30 days as outlined in our Privacy Policy.

4. Health and Safety Disclaimers

4.1 Medical Disclaimer

The information and recommendations provided by MyRunCoach are for general informational purposes only and should not be considered medical advice. You should:

• Consult a physician before starting any fitness program
• Stop exercising and seek medical attention if you experience pain, dizziness, or discomfort
• Inform your healthcare provider about your use of fitness apps
• Not rely solely on the App for health-related decisions

4.2 Assumption of Risk

You acknowledge that physical exercise involves inherent risks of injury. By using the App, you voluntarily assume all risks associated with exercise and running activities.

4.3 Data Accuracy

While we strive for accuracy, GPS tracking, heart rate monitoring, and other measurements may not be completely accurate. Do not rely solely on App data for critical health decisions.

5. User Conduct and Responsibilities

5.1 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You will not:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Transmit harmful, threatening, or offensive content
• Attempt to gain unauthorized access to the App or our systems
• Interfere with the App's functionality or other users' experience
• Use the App for commercial purposes without permission

5.2 Community Guidelines

When participating in community features, you agree to:

• Treat other users with respect and courtesy
• Not engage in harassment, bullying, or discrimination
• Share accurate information about your activities
• Respect others' privacy and personal information

5.3 Content Sharing

Any content you share through the App (routes, photos, comments) remains your property, but you grant us a license to use, display, and distribute such content within the App.

6. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

• You can delete your data and account at any time

7. Intellectual Property Rights

7.1 Our Intellectual Property

The App, including its design, functionality, algorithms, and content, is protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute the App
• Reverse engineer or attempt to extract source code
• Use our trademarks or logos without permission
• Create derivative works based on the App

7.2 Third-Party Content

The App may include content from third parties. We respect intellectual property rights and expect our users to do the same.

7.3 Apple Disclaimer

MyRunCoach is not affiliated with, endorsed by, or sponsored by Apple Inc. Apple is not responsible for the App or any claims, damages, or other liabilities arising from its use.

8. Subscription and Payment Terms

8.1 Subscription Pricing and Terms

MyRunCoach offers two auto-renewing subscription options to access premium features, including personalized training plans and advanced analytics:

• Monthly Subscription: $9.99 per month
• Annual Subscription: $99.99 per year

8.2 Payment and Renewal

• Payment: Payment will be charged to your iTunes Account (iOS) or Google Play Account (Android) at confirmation of purchase.
• Auto-Renewal: Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• Renewal Charge: Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen package ($9.99 monthly or $99.99 annually).

8.3 Cancellation and Management

You can manage your subscription and turn off auto-renewal by going to your Account Settings after purchase.

• iOS: Go to Settings > [Your Name] > Subscriptions.
• Android: Go to Google Play Store > Profile Icon > Payments & subscriptions.

Effect of Cancellation: If you cancel, you will continue to have access to premium features until the end of your current billing period.

8.4 Free Trials

Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription to that publication, where applicable.

8.5 Price Changes

We reserve the right to adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion. Any price changes will take effect following email notice to you.

8.6 Refunds

Refund requests are handled directly by the respective app store:

• iOS: Refunds are managed by Apple. We cannot issue refunds for purchases made through the App Store.
• Android: Refund requests must be made through Google Play.

No Pro-Rating: We do not offer refunds or credits for partially used subscription periods.

9. Limitation of Liability

To the maximum extent permitted by law, E.W. Technologies, LLC and its affiliates will not be liable for:

• Any injuries or health issues arising from use of the App
• Inaccurate data or measurements provided by the App
• Loss of data or interruption of service
• Indirect, incidental, or consequential damages
• Issues arising from third-party integrations or services

Our total liability for any claims related to the App will not exceed $100 or the amount you paid for the App in the last 12 months, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless MyRunCoach from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you share through the App

11. Termination

11.1 Termination by You

You may stop using the App at any time and delete your account through the App settings.

11.2 Termination by Us

We may suspend or terminate your access to the App if you:

• Violate these Terms
• Engage in harmful or disruptive behavior
• Provide false or misleading information
• Use the App for illegal purposes

11.3 Effect of Termination

Upon termination, your right to use the App will cease immediately, and we may delete your account and data as described in our Privacy Policy.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of State of Alabama without regard to conflict of law principles.

12.2 Dispute Resolution

Any disputes arising from these Terms will be resolved through binding arbitration, except for claims that may be brought in small claims court.

13. General Provisions

13.1 Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through the App or via email. Continued use of the App constitutes acceptance of updated Terms.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

13.3 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyRunCoach regarding the App.
